Getting a Collier County Marriage License

The Collier County Clerk Recording Department issues all marriage licenses in the county. Both applicants must appear together at the same time at the Clerk's office in Naples. The Clerk also performs ceremonies at all office locations and online via Microsoft Teams, making it one of the few clerk offices in southwest Florida that handles both license issuance and online ceremony services in one place.

Florida sets the minimum age at 18 for a standard marriage license. Applicants who are 17 must contact the office directly because a different process applies. Each applicant must show a valid Driver's License, State ID, Military ID, or Passport. U.S. citizens must supply their Social Security number. Non-U.S. citizens may use a Social Security number, Alien Registration Number, or another accepted identifying number. If both applicants have biological children born in Florida together, they must complete and attest an Affirmation of Common Children form. Both parties must also read the Family Law Handbook before the Clerk will issue the license.

Florida law imposes a three-day waiting period for state residents after the license is issued. The waiting period is waived when both applicants present certificates showing they finished an approved premarital course. Out-of-state residents do not face the three-day wait. Once issued, the license is valid in any Florida county for 60 days. After the ceremony, the officiant or couple must return the license to the issuing county within 10 days. Online ceremonies are processed automatically, so no separate return step is required for those.

How to Apply for a Collier County Marriage License

Most couples can walk in during business hours without a prior appointment for an in-person license. Online license applicants must book a future appointment for the Microsoft Teams ceremony call; same-day online service is not available. Gather all required documents before you arrive because the Clerk needs to verify identification and collect the Affirmation of Common Children form on the spot if it applies.

  1. Confirm that both applicants are 18 or older. If either applicant is 17, call the Clerk's Recording Department at (239) 252-2646 before visiting to learn the applicable process.
  2. Gather each applicant's government-issued photo ID. Accepted forms are a Driver's License, State ID, Military ID, or Passport. Non-U.S. citizens should also bring their Alien Registration Number or other accepted identifying number.
  3. Locate each applicant's Social Security number. U.S. citizens are required to provide it. If you are not a U.S. citizen, bring whichever alternate number applies to your situation.
  4. If you have biological children born in Florida together, download and complete the Affirmation of Common Children form from the Clerk's website before your visit. The Clerk charges $7 to file this form.
  5. Read the Florida Family Law Handbook. The Clerk requires both parties to confirm they have read it before the license is issued. It is available on the Florida Courts website.
  6. Visit the Clerk's office at Suite 102, 3315 Tamiami Trail East, Naples, FL 34112. Both applicants must appear at the same time. Pay the license fee of $86, or $61 if you both bring premarital course completion certificates. Credit card payments in person carry a 3.5% processing fee.
  7. If you are a Florida resident and did not complete a premarital course, wait the three-day period before the ceremony. Non-residents and couples with premarital course certificates may proceed right away.
  8. After the ceremony, the officiant or couple must return the license to the Collier County Clerk within 10 days. The Clerk records it in the Official Records system and will issue any certified copies you order.

Note: Online ceremonies apply only to licenses issued online from Collier County. Applicants need a video/audio-capable device with a working camera, a valid email address, and must be physically in Florida during the ceremony and attest to that fact during the Teams call.

Collier County Divorce Records and How to Search

Divorce cases in Collier County are filed with the Clerk's Family Law/Civil Department as dissolution of marriage actions. Florida is a no-fault state, so neither spouse needs to prove wrongdoing. The only ground for dissolution is that the marriage is irretrievably broken, or that one party is permanently incapacitated. Most dissolution petitions are filed in the Circuit Court, which handles family law across the Twentieth Judicial Circuit.

Court case records for dissolution of marriage are searchable through the Clerk's ShowCase Web portal. Select the Domestic Relations/Family case type in the dropdown to narrow results to family law matters. You can then search by party name, case number, or date range. The results grid shows case number, file date, party names, case type, and status. Clicking a case number opens detail tabs for parties, dockets, charges, fees, and court events.

Not everything in a divorce file is visible online. Florida Rule of General Practice and Judicial Administration 2.420 controls public access to judicial branch records. Sensitive documents in family cases, including financial affidavits, minor children's information, and domestic-violence-related materials, may carry restrictions that block internet access even when the case index is visible. The Clerk's public terminals at the courthouse may provide access to additional documents for authorized users.

  • Case number format in ShowCase uses the local identifier, such as year, case type, and sequence.
  • Domestic Relations/Family is the case type to select when looking for dissolution actions.
  • Party name searches return results for both petitioner and respondent.
  • Docket entries show filing events but may not display attached documents if they are restricted.
  • Fee tabs show outstanding balances; certified copy requests are separate from online viewing.

Family Law Privacy and Rule 2.420 in Collier County

Florida's judicial-branch access framework treats family court records differently from most other case types. Florida Rule 2.420 sets out which records are confidential, which are restricted, and which are open to the public internet. Family cases often involve information about minors, domestic violence victims, financial accounts, and medical details. Under the rule, filers must file a Notice of Confidential Information when a document contains protected material, and the Clerk applies corresponding access restrictions.

The Security Matrix maintained by the Florida State Courts System controls what any internet user can see in an online case portal. Even if a dissolution of marriage case appears in the ShowCase index, certain docket entries and attached documents may be blocked for internet users while remaining accessible at the courthouse. Parties and their attorneys can log in as registered users with expanded access under the matrix. Anyone who needs a specific document that does not appear online can request it through the Clerk's document request service or visit the public counter at Suite 102.

For Official Records, F.S. 119.0714 lets individuals request removal of exempt information or images from the Clerk's public website in certain categories, including records governed by family, juvenile, or probate rules. The Clerk's notice on the Official Records site confirms this right. Grantor/grantee/party index names are not removed from the index even when an image is removed.

Getting Certified Copies of Collier County Marriage and Divorce Records

Certified copies of recorded marriage licenses are available from the Clerk's Recording Department. Each additional certified copy costs $3. The Clerk charges a postage fee of $1.78 for up to six certified copies mailed in one envelope. Online credit card payment carries a 4.0% processing fee; in-person card payment is 3.5%.

For certified copies of divorce records, use the Clerk's document request page or visit the public counter. Court-issued certified copies are needed for legal proceedings, insurance claims, name changes on government IDs, and similar matters. Uncertified printouts from online portals are not accepted in most official proceedings. If you use the eCertify system, visit the Clerk's eCertify portal for electronically certified documents directly from the ShowCase system.

Processing time for copy requests depends on current workload at the Clerk's office. Walk-in requests during business hours at Suite 102 are typically handled the same day for standard records. Mailed requests take longer. The Clerk's website notes brief maintenance outages are possible; plan requests before any deadline.

Florida Vital Records for Marriage and Divorce

Florida's Bureau of Vital Statistics holds official state-level records of marriages and divorces. These are separate from the Collier County Clerk's records. The state office maintains records of marriages that occurred throughout Florida and can issue certified copies to eligible requesters. Divorce records at the state level are sometimes called dissolution records. The state office can confirm whether a marriage or divorce was recorded in Florida, which is helpful when the county of filing is unknown.

Florida requires requesters to provide proof of eligibility to receive certain certified vital-records copies, particularly for marriages and divorces that are not yet part of the open-records set. Identification and a relationship statement may be required. Fees and processing times vary by request type and delivery method.
